Updated Safe Harbor Table (Notice 2025-08)

Effective January 16th, Treasury released the “First Updated Elective Safe Harbor” guidance (Notice 2025-08) modifying the previous Domestic Content “New Elective Safe Harbor” (Notice 2024-41).

Until 90 days from effective date (until 4/16), taxpayers may rely on either the “First Updated Elective Safe Harbor” (08) or the “New Elective Safe Harbor” (41)  Notice 2023-38 (Direct Cost) will remain an option.

*As it relates to the domestic content rules, the U.S. Department of Treasury and the IRS have not yet issued proposed or final regulations. Rather, the IRS has issued three notices - Notice 2023-38, Notice 2024-41 and Notice 2025-08. These notices provide guidance regarding the domestic content rules. SolarEdge and Enstall products referenced herein are manufactured with the intent to be eligible for inclusion under the elective safe harbor table in calculating the Domestic Cost Percentage under the “Rooftop (MLPE)” category (under IRS Notice 2025-08). Eligibility is subject to the installation of qualified USA-Manufactured inverters and Power Optimizers (C651U) in the same project. SolarEdge and Enstall do not provide tax and/or legal advice. You should consult with your own legal and/or tax advisor(s) regarding the eligibility of your project for the ITC or PTC, including the 10% Domestic Content bonus, to determine how the applicable rules apply to your project. What is an AUP?

  • Performance of specific procedures agreed upon by the client and any relevant third parties.
  • Provides factual findings based on the procedures, without offering an opinion or assurance.
  • Allows users of the report to draw their own conclusions from the findings. It’s often used in situations where stakeholders need specific information or verification but do not require a full audit or review.
  • Users that can use the AUP:
    • Customers purchasing the products
    • Financiers of the customers
    • Counsel to these parties
    • ITC Insurance brokers providing a policy to a customer's project
