SolarEdge NSW Home Battery Cashback Promotion – Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY PARTICIPATING IN THE SOLAREDGE PROMOTION, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. THESE TERMS AND CONDITIONS ARE SUBJECT TO CHANGE WITHOUT NOTICE, FROM TIME TO TIME AT OUR SOLE DISCRETION. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE DO NOT ENROLL IN THE PROGRAM.

1. General. To promote SolarEdge Home Battery systems in New South Wales (“NSW”) we are introducing the “SolarEdge NSW Home Battery Cashback Promotion” (the “Promotion”). Subject to the Terms and Conditions provided hereinafter, SolarEdge will provide electronic gift cards to Australian Homeowners that shall meet the requirements set forth herein.
SolarEdge's decision on all matters relating to this Promotion shall be final and binding.

2. Gift Card entitlement. The participant will have to meet all the following conditions within the Term of the Promotion to be entitled to a gift card in the amount of AUD 500 (the “Gift Card”). 

• (1)    The participant purchased and installed a SolarEdge Home Battery system (the “System”) in NSW Australia.
  
  
• (2)  The System is connected to a SolarEdge Residential Inverter and SolarEdge Monitoring Portal (active internet connection is required).
• (3)    The System was purchased from SolarEdge’s certified reseller or installer.
• (4)    The participant submitted a request form with the Site ID for the System with a NSW address and tax invoice with product information as proof of purchase during the Term of the Promotion. • If in SolarEdge's sole discretion, a participant breaches any of these terms and conditions, acts unlawfully, tampers or attempts to tamper with the Promotion, jeopardizes the fair and proper conduct of the Promotion, or acts improperly or unethically, SolarEdge reserves the right to disqualify any participant, and/or disqualify the request claim and, in such event, any entitlement for a gift card will be forfeited 

3. Promotion Term. 
(1)    The Promotion will commence on September 1 2024 and will end on 31 December 2024 (the “Term”). For the avoidance of doubt, all the entitlement terms detailed in section 2 above must be met before the end of the Term.
(2)    The total amount of Gift Cards offered within the framework of this Promotion is limited to no more than AUD 300,000, all subject to SolarEdge's sole discretion as described above.

4. Participation.

• (1)  Only systems installed on sites in NSW and registered accordingly with an NSW address in SolarEdge’s Monitoring Portal are allowed to be enrolled by participants as part of this Promotion.  
  (2) For clarity, by participating in this Promotion, each participant acknowledged that for sites awarded with a Gift Card under this Promotion, the participant will not be entitled to any other SolarEdge incentive.

5. Provision of the Gift Card.

• (1)  The gift card will be provided by a third-party provider (the “Gift Card Vendor”). SolarEdge shall inform eligible participants of the Gift Card Vendor’s procedure for receiving the gift card. In case of failure to follow this procedure, the participant’s gift card eligibility will not be valid.
  (2)    Once the eligibility to receive a gift card is confirmed by SolarEdge, at its sole discretion, SolarEdge will approve the Gift Cards Vendor to provide the participant with the applicable gift card within 90 days.  
  (3)    Each Gift Card is per each purchase of a System as defined in these Terms and Conditions 
  (4)    Participants shall be responsible for all taxes, rates, government fees, or any other costs related to receiving any Gift Card under this Promotion. 
• 6. Liaility.  

• (1)   SolarEdge shall not be liable for any losses, damages, or expenses incurred by participants as a result of participating in the Promotion, and to the fullest extent permitted by law, each participant hereby releases SolarEdge from any claim, costs, damages, expenses, and losses that such participant may suffer or incur as a result of SolarEdge's action or inaction arising out of or in connection with this Promotion.  
  (2)    In no event shall SolarEdge be liable to a participant or the end-user of the System or any product for any special, consequential, punitive, incidental, or indirect damages, however, caused, including, without limitation, loss of business, revenue, profits, goodwill, use, or other economic advantages, however they arise, whether in breach of contract, breach of warranty, or in tort, including negligence, and even if SolarEdge has previously been advised of the possibility of such damages.  

7. Termination.  

• (1)   SolarEdge reserves the right to extend/cancel/change this Promotion at its sole discretion without incurring any obligation to inform the participants.
  (2)    Without derogating from the generality of the above, SolarEdge may terminate this Promotion or refuse to pay any gift card in any of the following events: (a) unremedied breach of these Terms and Conditions; or (b) where any bankruptcy, insolvency, liquidation, reorganization or similar proceedings are commenced with respect to a participant.
  (3)    Upon termination of this Promotion for any of the events indicated above, SolarEdge will be released from any further obligations to a participant as part of this Promotion.

8. Privacy. Any information collected by SolarEdge for the purposes of these terms is held and used by SolarEdge subject to its privacy policy available at: https://www.solaredge.com/privacy-policy.

9. Governing Law. This Campaign will be exclusively governed by the laws of Israel, without regard to its conflict of laws principles. Any dispute will be submitted to the exclusive venue of the appropriate courts located in Tel Aviv. This Campaign is void where prohibited by law.
