SolarEdge 2024 Yield Advantage Campaign – Terms & Conditions

By participating in this campaign, you are deemed to have accepted these terms and conditions: 

1. General. To promote SolarEdge systems in Australia we are introducing the “SolarEdge 2024 Yield Advantage Campaign” (the “Campaign”) . Subject to the Terms and Conditions provided hereinafter, SolarEdge will provide gift cards to qualified Australian installers that shall meet the requirements set forth herein.   SolarEdge's decision on all matters relating to this Campaign shall be final and binding.

2. Gift Card entitlement. The gift card amounts shall be as described in the table below:

The participant will have to meet all the following conditions within the Term of the Campaign to be entitled to a gift card

• (1) Purchase SolarEdge’s Commercial Inverters, together with the required number of P Series Optimisers*, from an authorized Australian distributor of SolarEdge within the term of the Campaign.
  
  
• (2) Submit a request form along with the proof of purchase tax invoice with product information to support the purchase of the said products during the term of the Campaign. The request form is available at: https://marketing.solaredge.com/en-au/commercial-cashback-giftcard-offer-australia
• (3) If in SolarEdge's sole discretion, a participant breaches any of these terms and conditions, acts unlawfully, tampers or attempts to tamper with the Campaign, jeopardizes the fair and proper conduct of the Campaign, or acts improperly or unethically, SolarEdge reserves the right to disqualify any participant, and/or disqualify the request claim and, in such event, any gift card will be forfeited.
• (4) Exclusion: The campaign does not apply to products purchased directly from SolarEdge or sub-distributors of SolarEdge's products 

3. Campaign Term. 

(1)The Campaign will commence on 1 June 2024 and will end on September 2, 2024
(2)   The total amount of Gift Cards offered within the framework of this Campaign is limited to no more than AUD 630,000, all subject to SolarEdge's sole discretion as described above.

4. Participation.

• (1) Only qualified Australian solar installers are allowed to enroll as participants as part of this Campaign.
• (2) For clarity, by participating in this Campaign the participants acknowledge that sites that were awarded with a gift card under this Campaign will not be entitled to any other SolarEdge incentive program during the term of the Campaign.

5. Provision of the Gift Card.

• (1) The gift card will be provided by a third-party provider (the “Gift Card Vendor”). SolarEdge shall inform eligible participants of the Gift Card Vendor’s procedure for receiving the gift card. In case of failure to follow this procedure, the participant’s gift card eligibility will not be valid.
• (2) Once the eligibility to receive a gift card is confirmed by SolarEdge, at its sole discretion, SolarEdge will approve to Gift Cards Vendor to provide the participant with the applicable gift card within 90 days.
• (3) The gift card is per each purchase of Products as defined in these Terms and Conditions.
• (4) Participants shall be responsible for all taxes, rates, government fees, or any other costs related to receiving any gift card under this Campaign. 

6. Liability.  

• (1) SolarEdge shall not be liable for any losses, damages, or expenses incurred by participants as a result of participating in the Campaign, and to the fullest extent permitted by law, each participant hereby releases SolarEdge from any claim, costs, damages, expenses, and losses that such participant may suffer or incur as a result of SolarEdge's action or inaction arising out of or in connection with this Campaign.
• (2) In no event shall SolarEdge be liable to a participant or the end-user of the Products for any special, consequential, punitive, incidental, or indirect damages, however, caused, including, without limitation, loss of business, revenue, profits, goodwill, use, or other economic advantages, however they arise, whether in breach of contract, breach of warranty, or in tort, including negligence, and even if SolarEdge has previously been advised of the possibility of such damages.

7. Termination.  

• (1) SolarEdge reserves the right to extend/cancel/change this Campaign at its sole discretion without incurring any obligation to inform the participants.
• (2) Without derogating from the generality of the above, SolarEdge may terminate this Campaign or refuse to pay any amount or provide gift cards in any of the following events: (a) unremedied breach of these Terms and Conditions; or (b) where any bankruptcy, insolvency, liquidation, reorganization or similar proceedings are commenced with respect to a participant.
• (3)  Upon termination of this Campaign for any of the events indicated above, SolarEdge will be released from any further obligations to a participant as part of this Campaign.

8. Privacy. Any information collected by SolarEdge for the purposes of these terms is held and used by SolarEdge subject to its privacy policy available at: https://www.solaredge.com/privacy-policy.

9. Governing Law. This Campaign will be exclusively governed by the laws of Israel, without regard to its conflict of laws principles. Any dispute will be submitted to the exclusive venue of the appropriate courts located in Tel Aviv. This Campaign is void where prohibited by law.
